Program Terms And Conditions
The materials and concepts of The Strategic Coach® Program (“Program”) are designed to help you (“Participant”) achieve extraordinary goals and clearly define your unique talents and the passion that drives you. The Program will help you think through goals and strategies and provide you with a structure to help you focus more efficiently. In order to assist us in maintaining the unique value you will experience as a participant in the Program, you acknowledge that you have read, understood, and agreed to the following Terms And Conditions (“Terms”).
Conditions Of Your Application
Your Investment Fee (“Fee”) permits you to access the Program and its content. The Program is intended solely for your own personal, professional, educational, and non-commercial use. Depending on the specific type or level of the Program in which you enroll, your Investment Fee may include workshop sessions, Bootcamp sessions, Coach Connection sessions between your workshops, access to the Coach Connect client website, one-on-one support from a Program Advisor, and additional resources and support. Your membership in the Program begins on the date of the first workshop session you attend. There is no credit for missed sessions. The enclosed fee is non-refundable. By signing up for or subscribing to any of the Strategic Coach Services, or filling out any Strategic Coach download forms, you are providing your express consent to be contacted by us via commercial electronic messages, mail, text, SMS, MMS, telephone or otherwise, to notify you about new products, services, and features offered by Strategic Coach. You may withdraw your consent at any time.
Intellectual Property
You acknowledge and agree that the Program includes content protected by copyright, patent, trademark, trade secret, and/or other intellectual property and proprietary rights and laws. No right, title, or interest in any intellectual property or other proprietary right shall be transferred to you by your participation. Any reproduction, presentation, distribution, transmission, or commercial use of the concepts, strategies, tools, worksheets, books, methods, materials, and all other trademarks, copyrights, and other intellectual property owned by The Strategic Coach Inc. (“Strategic Coach”) in any media, now known or hereafter developed or invented, is prohibited without the express written permission of Strategic Coach®. You agree not to record, upload, teach, coach, share, or otherwise distribute the Program, in whole or in part.
Confidentiality
You agree to keep confidential any materials relating to or that may be shared during the Program by Strategic Coach, by its coaches or employees, or by your fellow participants. This includes, but is not limited to, any story or other show of concepts and any materials or information supplied by third parties that you may be given access to or that may be shared or discussed during the Program. You agree not to release such information or materials during or after the completion of the Program without the prior written approval of the relevant owner and Strategic Coach. Any information and/or materials you may disclose to the participants and Strategic Coach during the Program will be considered as being released with your consent. Strategic Coach will not be held liable for the actions of any third parties. Any workbooks, viewing materials, or links, etc. that may be supplied or information that may be shared will be for the educational and informational purposes of the Participant only in relation to the Program. Recording of the Program, whether in whole or in part, is not permitted.
Some Additional Rights Reserved By Strategic Coach
Strategic Coach has the right to reschedule workshops, change the venue, substitute coaches, and/or change in-person workshops into engaging virtual-only-basis workshops using videoconferencing services. Strategic Coach reserves the right to decline or terminate your participation in the Program for any reason at any time, including, for example, for failing to comply with these Terms And Conditions. Please note that receipt of your application does not guarantee your enrollment into the Program and we advise that you contact one of our Sales Membership Advisors to ensure your enrollment before making travel arrangements. Strategic Coach cannot be held liable for any expenses incurred in the event that the Program reaches capacity, there is a change in venue, or if the delivery method of the workshop session changes. Strategic Coach reserves the right to process payments via a third-party payment processor and are subject to the terms of use and privacy policies of those payment gateways and are not accessible or controlled by Strategic Coach. You hereby authorize the third-party agent to charge your credit card for the Services, both in advance and on a periodic, renewal basis if applicable and in accordance with any terms and conditions of your Application. The payment agent is acting solely as a billing and processing agent on behalf of Strategic Coach. Any third-party payment agent is not permitted to store, retain or use your billing information except to process payment for the Services you are registering for.
Responsibility For Your Decisions And Conduct
The Program is not a substitute for the advice of any of your personal or professional advisors; therefore, you agree that all of your decisions and actions, and their consequences, are entirely your own responsibility. You are responsible for your own conduct before, during, and after the Program.
Release Of Liability
You release Strategic Coach and its officers, directors, owners, and employees from any and all liability arising from or connected to the Program. You also agree to release Strategic Coach from any responsibility if you choose to accept Strategic Coach’s offer to provide and/or arrange transportation to and from your sessions.
Assumption of Risk And Waiver Of Liability
By attending and voluntarily participating in my in-person workshop presented by Strategic Coach, I agree and understand that there are inherent risks of exposure to any communicable or infectious disease, which exist in any public place where people are present, and that no precautions can eliminate the risk of exposure to any communicable disease. I agree to voluntarily assume any and all risks in any way related to exposure to any communicable or infectious disease, related to attending and/or participating in a Strategic Coach workshop. In addition to taking responsibility for my own health and safety, I agree to follow the protocols dictated by public health and those of the venue where the workshop is being held. I agree to assume all the foregoing risks and accept sole responsibility for my health and safety, and I discharge Strategic Coach of any liability that may otherwise arise due to any exposure to any infectious disease at or near or in transit to/from the venue, and/or in relation, directly or indirectly, to my workshops. I agree to release Strategic Coach from any and all causes of action, claims, demands, requests, damages, or any recourse whatsoever in respect of any personal injuries or other damages that may occur or arise as a result of exposure to any infectious communicable disease. I understand and agree that I am not relying on Strategic Coach to have arranged for, or carry, any insurance of any kind for my benefit relative to my attendance and participation in the workshop and that I am solely responsible for obtaining any mandatory or desired life, travel, accident, property, or other insurance related to my attendance and participation in a Strategic Coach workshop at my own expense.
Technical Requirements For Virtual Workshops
You agree that only you will have access to the Program, and you agree that your access is non-transferable. You acknowledge and agree that the technical transmission of the Program content, including any content that may be provided by the participant(s), will involve transmission over various third-party videoconferencing and webinar delivery services and devices, and it is your responsibility to ensure you meet the requirements for a stable connection to such third-party videoconferencing and webinar delivery services or devices. This includes, but is not limited to, having appropriate hardware, software, network connectivity, and bandwidth. Strategic Coach will notify you of the details of the third-party videoconferencing and webinar delivery service. Strategic Coach’s use of such delivery service is neither an endorsement nor a recommendation of such delivery service. It is your responsibility to ensure, in advance, that you have a secure connection. Strategic Coach shall have no liability or responsibility for the videoconferencing and webinar delivery services. Strategic Coach has the right to change the videoconferencing platform at any time and for any reason and has the right to record your workshop session for quality assurance and staff training purposes. Please note that Strategic Coach will not be posting a recording of the online session.
Privacy Policy: Protecting Your Personal Information
This Privacy Notice below summarizes some of the ways in which Strategic Coach collects, uses, protects, and discloses information about you. A full version of Strategic Coach’s Privacy Policy practices in relation to the Program is available at www.strategiccoach.com/privacy.
Strategic Coach collects personal information in the Confidential Application, as well as income verification you submit as part of the application process (“Personal Information”). By providing Personal Information to Strategic Coach, you consent to Strategic Coach using the information for the purposes specified in our Privacy Policy. When you participate in Strategic Coach, your professional and/or personal contact information will be posted on Coach Connect and accessible by other participants in your workshop. If you do not wish to share your information with other participants, you can opt out by emailing us at legalinfo@strategiccoach.com. Strategic Coach does not rent, sell, or otherwise disclose Personal Information about its clients to third parties. Strategic Coach may allow authorized third-party service providers access to Personal Information to perform services on its behalf. These service providers are required to provide appropriate privacy protection for the Personal Information, comparable to that of Strategic Coach, and to limit their use of such information to providing services on behalf of Strategic Coach. Strategic Coach will use its best efforts to protect your personal information against loss and unauthorized use. Our sessions may also be monitored and recorded for quality assurance and training purposes. If any part of these Terms is declared invalid or unenforceable by a court of competent jurisdiction, the balance of these Terms shall remain valid.
